- Motions for Continuance: If a continuance is desired, a written request must be filed at least 8 days prior to the hearing date. The request must set forth the reason a continuance is warranted. Any motion for continuance should state that opponents or parties in interest have been contacted and either consent or oppose the continuance. If the request for continuance is granted, an order will be docketed at least 2 days prior to the hearing date. If an order has not been entered 2 days before the hearing date, the court will hear the matter.
- Unopposed Motions: Unopposed requests for relief may be granted without hearing if they are sufficiently pled. If the court grants the unopposed motion without hearing, an order will be docketed at least 2 days prior to the hearing date. If an order has not be entered 2 days before the hearing date, the court will hear the matter. Please see the pleading requirements for motions to lift stay.
Motion Day Docket
- Emailed Motion Day Docket: If you have put in a request to the Clerk’s Office, the court will email you a copy of the motion day docket on the day before the hearing. If your matter appears on the docket, the court will hear the matter. Do not call chambers about hearings. If you would like to be added to the court’s email list, please email the Clerk’s Office at webmaster@laeb.uscourts.gov
Objections/Responses/Settlements
- Objections and Responses: The court will only consider written objections and responses that are filed at least 8 days prior to the hearing date.
- Settlements: The parties must file a written request for approval of settlement at least 8 days prior to the hearing date, or the matter will be heard and dispensed with on the merits. Any request for approval of a settlement shall be noticed to all opponents or parties in interest.
